Family Dollar Stores of Connecticut, Inc., Manager Overtime Case
In this action, we are suing Family Dollar Stores of Connecticut, Inc. for overtime wages that we believe are due Store Managers at Family Dollar Stores in Connecticut. Family Dollar Stores of Connecticut, Inc. classifies its Store Managers as exempt "Executives" and does not pay them for hours worked beyond 40 in a week.
We believe that Store Managers spend most of their time performing non-exempt work like processing shipments, stocking shelves and ringing the cash register, so they should not be classified as exempt "Executives." We believe that Store Managers should be paid one and a half times their regular rate for their overtime hours.
We are not alone in this opinion. In 2008, the Eleventh Circuit Court of Appeals affirmed a $54,000,000 ruling in favor of approximately 1,400 Store Managers who had joined a similar suit in Alabama. Those Store Managers prevailed because they showed that most of their work was not management but instead consisted of unloading trucks and stocking shelves. There are also a growing number of state lawsuit around the country.
