Overtime for Inside Salesperson

Can my employer deny overtime to an inside salesperson? 

     Maybe.  This issue has not been the subject of as much litigation as the overtime exemption for outside salespeople.  Under Connecticut law, an employee may be exempt if he or she meets all of the following requirements: 

        -the employee’s sole duty is sales of the company’s product or  service
-the employee’s regular rate of pay is at least twice the minimum wage (presently $8.25 per hour)
-more than half the employee’s compensation comes from commissions
-the employee does not work more than 54 hours per week. 

     It seems as though this statute applies to relatively few inside salespeople, and the requirements are strict.  As with all remedial laws, this exemption is to be narrowly construed in favor of the employee’s right to overtime compensation.
