Termination Based on Wages

Can my boss fire me because  I make too much money?

Replacing an employee with someone who makes less money in order to save on payroll expenses is valid under Connecticut and federal law.  However, if your employer talks about how long you’ve been on the job or wanting someone with “more energy” or “new ideas,” you may be the victim of unlawful age discrimination.  Further, if you think you’re being terminated because you’re about to be eligible for your pension or other retirement funds, your termination may violate the federal Employee Retirement Income Security Act (ERISA).  For more information on ERISA and retaliation, visit:
https://www.dol.gov/ebsa/faqs/faq_compliance_pension.html.

You may also be able to negotiate a severance agreement with your employer or even a different pay and benefits plan in order to keep your job.  If you have questions about these issues, contact us!
